Renewal or Maintenance

Is this a 5-6 year maintenance filing or a 9-10 year renewal?

This refers to how long ago your trademark reached registration, not how long you want to renew the trademark.

5-6 Year Maintenance, Section 8 or Section 71 Declaration. ($399 Professional Fee)

9-10 Year Renewal, Section 9 and Section 8. ($399 Professional Fee)

How many classes of goods or services are you maintaining for your trademark?

A $375 filing fee per class is required. This covers the $325 government fee (as of January 2025) as well as payment processing and labor. Let us know in the "additional notes" section if you'd like to delete any classes from your trademark and thus reduce the filing fee.

How many classes of goods or services are you renewing for your trademark?

The filing fee for the first class is $665. A $755 filing fee for each additional class is required. This covers the $650 government fee (as of January 2025) as well as payment processing and labor. Let us know in the "additional notes" section if you'd like to delete any classes from your trademark and thus reduce the filing fees.

(Optional) Would you also like to file for Incontestability?

If you'd like, we can also file a §15 affidavit to have your trademark declared "Incontestable", which makes it much harder for opponents to attempt to challenge your registration. We charge $250 for this, plus a $305 filing fee per class that covers the $250 government fee (as of January 2025) plus payment processing and labor.

All fees held by the law firm are fully refundable. Fees will be treated as the law firm's own until client requests a refund or services are rendered. Note that if your registration is past or within a few weeks of the initial filing deadline, the law firm may need to send you an online invoice to cover the USPTO's penalty fees plus a $25 surcharge, especially if you don't warn them in the "Additional Notes" section of this form.
