CLASS 28: Playing cards and card games

Included Domain Name:

DatingisaGift.com

Additional Notes:

Dating is a Gift encapsulates a fresh, positive outlook on the world of dating, making it a standout name for a business in trademark class 28, which includes playing cards and card games. This unique name immediately piques interest, promising not just entertainment but an enriching experience that views dating through a joyful and appreciative lens. Paired with the matching domain name, DatingisaGift.com, the brand has a solid foundation for building a strong online presence.

At its core, the name Dating is a Gift suggests that dating is not merely a search for a partner but a valuable experience in its own right. It’s a perspective that can resonate deeply in today’s dating culture, often marred by transient connections and fleeting interactions. This name brings a refreshing change, emphasizing dating’s potential for growth, self-discovery, and the joy of meeting new people. It’s an optimistic take that can appeal to a wide audience looking for something more meaningful in their dating lives.

Moreover, by framing dating as a ‘gift,’ the name imbues the concept with a sense of wonder and appreciation. It encourages players to see each date not as a step towards a goal but as a unique gift—an opportunity to learn, to share, and to connect on a deeper level. This approach can transform how people view and engage with dating, making it a more thoughtful and gratifying experience.

The application of this concept to playing cards and card games is both innovative and clever. It suggests that the business offers products designed to facilitate enjoyable, meaningful interactions between people. These could be card games that prompt deep conversations, share personal stories, or simply break the ice in fun and engaging ways. It’s a brilliant method to blend entertainment with the genuine human desire for connection, making the company’s offerings stand out in a market that often leans towards the superficial.

Furthermore, the domain name DatingisaGift.com offers an excellent platform for the business to expand its reach. It provides an easy-to-remember access point for customers interested in enhancing their dating experiences. Whether the site hosts an online shop for the card games, a blog with dating advice and stories, or forums for sharing experiences, it becomes a central hub for a community that views dating through a positive, enriching lens.

In essence, Dating is a Gift is more than just a business name; it’s a philosophy. For a company in trademark class 28, it promises not only a unique product but also a new perspective on dating. It’s a brand that can build a strong emotional connection with its audience, offering them not just fun and games but a fresh outlook on relationships. This name has the potential to redefine the market, making the brand a memorable and meaningful player in the industry.

Because it’s a fully registered trademark on the Principal Register, you’ll get instant Amazon Brand Registry access without having to worry about Amazon revoking your Brand Registry access later on because of a refusal by the USPTO.

Yes, you can pay in installments! Just add a trademark to your cart and begin the checkout process. Once you've started the checkout process, you can choose to pay in installments using PayPal, Afterpay, or Klarna. We are not yet able to offer Affirm because Affirm considers Communer a "B2B" business type, which Affirm does not currently support.

Any payment option available to you will be visible on the checkout page when you choose a payment method. If you don't see any of these options, then you or the product might not be eligible.

Most of our buyers become the new legal owner of the trademark within three days of paying for it. Shortly after payment is made, Communer generates a trademark assignment agreement for e-signature by both the buyer and seller. When both parties e-sign, the buyer is now the legal owner of the trademark.

As the buyer, you may want to record your assignment with the USPTO. This process does not change the legal owner, but it updates the ownership records in the public trademark database. The assignment recordation process usually takes about one month for the USPTO process, though it can take more like two months if complications arise. Once the assignment recordation process is complete, the USPTO will update the listed owner in its TESS search engine and its TSDR trademark records shortly after.

The buyer can usually file the assignment recordation themselves using the USPTO's Electronic Trademark Assignment System (ETAS) for $40. If you'd prefer to have an attorney to file it on your behalf, our partner firm JPG Legal can file the assignment recordation for $250 including the filing fee for one trademark, plus an additional $50 per trademark for additional trademarks transferred in the same deal. For example, if you bought a name trademark and a logo trademark together and you want to record both assignments, the total cost for record the assignment of both trademarks will be $300 including filing fees.

After you purchase a trademark on Communer, we'll give you next steps on how to have the assignment recorded if you're unsure how to do it on your own.

The seller does not need to file anything.

Most buyers will want to record their trademark assignment with the United States Patent and Trademark Office (USPTO) after they purchase a trademark on Communer. The assignment recordation process enters the ownership transfer into the public record and updates the trademark's listed owner in the publicly searchable trademark database.

Around half of Communer's buyers are Amazon sellers, so we make the Amazon Brand Registry process as quick and reliable as possible. Our buyers typically gain Amazon Brand Registry access within one week of paying for their trademark.

Once the buyer and seller both e-sign the trademark assignment agreement generated by Communer, the buyer can apply for Amazon Brand Registry using that trademark's registration number. Amazon will send a verification code to the seller, which the seller is then required to forward to the buyer in a timely manner as stated in the assignment agreements we generate.

As long as you apply for Amazon Brand Registry within two weeks of buying your trademark, the seller will not receive their money until you gain Amazon Brand Registry access. This ensures that the seller will do everything possible to give you access to Amazon Brand Registry as soon as possible.

Communer cannot control the actions of Amazon and thus we cannot guarantee that Amazon will grant the buyer Brand Registry access, but all trademarks we sell should be eligible for Amazon Brand Registry as long as they're not on the Supplemental Register. Very few Communer trademarks are on the Supplemental Register (as of this writing, none are). When trademarks are on the Supplemental Register, we warn you of that in the listing.

The vast majority of our trademark buyers are able to get Amazon Brand Registry without recording their trademark assignment with the USPTO. If for some reason you are unable to get Amazon Brand Registry at first, we recommend recording your trademark assignment with the USPTO, which we will give you details on how to do. The USPTO currently takes two business days to process an assignment recordation, plus about 3-7 calendar days to update the public database.

For buyers, Communer does not charge any additional fees beyond the purchase price.

For sellers, Communer charges a 15% commission from the sale price. Communer also deducts the payment processing fee for the purchase from the payout to the seller (typically about 3%, occasionally 5-6%).

The seller must also choose how they receive their payout, for payment processing fees may apply as well. The most affordable option is to have us send a check by mail for $1. We can also send the payout by bank transfer, PayPal, or Payoneer.

Communer does not charge any upfront fees for sellers. Go here for more details about selling a trademark on Communer.
