TTAB Motion To Extend Time To Answer (Opposition) Template

If somebody has filed a Notice of Opposition against your pending U.S. trademark application, or your client’s U.S. trademark application, you can use this template to buy yourself more time (40 days). You can then use that time to do the following:

1. Negotiate a co-existence agreement with the opposing party;
2. Find a litigation attorney to represent you or to take over for your client; or
3. Draft an answer to the Notice of Opposition and file it in response.

Just fill in the blanks and you have yourself a valid Motion to Extend Time To Answer that you can file with the Trademark Trial and Appeals Board (TTAB). This template has been used successfully dozens of times by our partner law firm, JPG Legal. It also includes the required Certificate of Service on the last page.
